CYBERPACK Platform Terms of Use

Welcome to the CYBERPACK Platform!
These Terms of Use (hereinafter referred to as the "Terms") govern your relationship with "CYBERPACK" LLP (hereinafter referred to as the "Company," "we," "us," or "our") and your use of our educational ecosystem, which includes the CYBERPACK App mobile application, a web platform for teachers and administrators, educational STEAM kits (regarding the use of their associated software and content), as well as all related services, content, and features (collectively referred to as the "Platform").
Please read these Terms carefully before using the Platform. By using the Platform or any part of it, you acknowledge that you have read, understood, and fully agree to these Terms. If you do not agree with any of these Terms, you must not use the Platform.
If the user is a minor (a child) who has not reached the age required to enter into legally binding agreements independently under applicable law, it is presumed that their parent or legal guardian has reviewed these Terms and the Privacy Policy and has consented to the child's use of the Platform.
1. Description of the CYBERPACK Platform
1.1. The CYBERPACK Platform is an innovative educational ecosystem designed to teach students aged 10 to 18 (and other age groups within adapted programs) the fundamentals of STEAM (Science, Technology, Engineering, Arts, Mathematics) through hands-on projects, interactive tasks, the use of modular hardware kits, a mobile application with an AI assistant, and a web platform for teachers.
1.2. We reserve the right to modify, suspend, or discontinue any part of the Platform or the entire service at any time, with or without prior notice.
2. Account Registration and Access
2.1. Access to certain features of the Platform may require you to create an account.
2.2. When registering, you agree to provide accurate, current, and complete information about yourself (or about the child, if you are a parent/guardian/teacher registering a student).
2.3. You are solely responsible for maintaining the confidentiality of your account information (login and password) and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
2.4. Access to the Platform may be granted upon the purchase of educational kits, a subscription, or through participation in pilot programs organized by the Company or its partners. The specific terms of access are determined by the relevant agreements or subscription terms.
2.5. We may provide schools or educational institutions with unique access codes for the registration of their students and teachers. The respective institution is responsible for the distribution and use of these codes.
3. Platform Usage Rules (Acceptable Use)
3.1. You agree to use the Platform only for lawful, educational, and personal non-commercial purposes (unless otherwise specified in a separate agreement with the Company).
3.2. You are prohibited from: a) Using the Platform in any way that could damage, disable, overburden, or impair it or the networks connected to it. b) Attempting to gain unauthorized access to any part of the Platform, other users' accounts, computer systems, or networks. c) Using the Platform to distribute spam, malware, or any other illegal or unsolicited content. d) Infringing upon the intellectual property rights of the Company or third parties. e) Decompiling, disassembling, reverse-engineering, or otherwise attempting to derive the source code of the Platform's software. f) Transferring your rights to use the Platform to third parties without our prior written consent (except where explicitly permitted by the subscription terms for educational institutions). g) Using the Platform for any activity that violates applicable law.
4. Intellectual Property
4.1. All rights to the Platform, including but not limited to the design, text, graphics, logos (including "CYBERPACK"), software code, educational materials, video tutorials, 3D models, projects, and other content (hereinafter "Company Content"), are owned by "CYBERPACK" LLP or its licensors and are protected by copyright and other intellectual property laws.
4.2. You are granted a limited, non-exclusive, non-transferable license to access and use the Company Content solely for personal, non-commercial educational purposes within the functionality of the Platform and under these Terms and your subscription/agreement.
4.3. Any use of the Company Content beyond the scope of the license granted, without our prior written consent, is strictly prohibited.
4.4. User Content: If the Platform allows you to upload, create, or publish your own content (e.g., solutions to problems, created projects, comments – hereinafter "User Content"), you retain all rights to it. However, by uploading User Content to the Platform, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, modify (e.g., for formatting), adapt, publish, translate, and distribute such content for the purposes of providing and improving the Platform's services (e.g., to display your projects in your academic portfolio, for analysis by the AI assistant to provide feedback, for sharing experiences within the community if such a feature is available and you have consented to it).
4.5. You are solely responsible for your User Content and you warrant that it does not infringe upon the rights of third parties or violate applicable law. We reserve the right to remove any User Content that violates these Terms or the law without prior notice.
5. Paid Services, Subscriptions, and Payments (If Applicable)
5.1. Access to certain features of the Platform or educational kits may be fee-based or provided on a subscription basis.
5.2. All payment terms, including costs, duration, renewal and cancellation policies, and refund conditions (if applicable), will be specified in the relevant section of the Platform during the purchase or subscription process, or in a separate agreement with your school/organization.
5.3. You agree to pay all applicable fees in a timely manner. We reserve the right to change the prices for our services upon prior notification to you.
6. AI Assistant and Generated Content
6.1. Our AI assistant is designed for educational support and to provide information. While we strive for its accuracy and usefulness, the answers and recommendations it provides should be considered supplementary and do not replace consultation with a qualified teacher or expert.
6.2. You are responsible for verifying and critically evaluating the information provided by the AI assistant.
7. Termination or Suspension of Access
7.1. We reserve the right to suspend or terminate your access to the Platform (or any part of it) at any time without prior notice if you breach these Terms, violate applicable law, or if your actions may cause harm to the Platform, other users, or the Company.
7.2. You may stop using the Platform and delete your account at any time in accordance with the procedures described in our Privacy Policy or in your account settings.
8. Disclaimer of Warranties and Limitation of Liability
8.1. The Platform is provided "AS IS" and "AS AVAILABLE" without any warranties of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
8.2. We do not warrant that the Platform will be uninterrupted, error-free, or that all defects will be corrected.
8.3. To the maximum extent permitted by applicable law, the Company, its officers, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages (including lost profits, loss of data, or damage to goodwill) arising out of the use of or inability to use the Platform, even if we have been advised of the possibility of such damages.
9. Indemnification
9.1. You agree to defend, indemnify, and hold harmless the Company, its officers, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Platform or your violation of these Terms.
10. Links to Third-Party Resources
10.1. The Platform may contain links to third-party websites or resources. We are not responsible for the availability, content, or accuracy of such third-party resources. Links to such resources do not imply our endorsement.
11. Changes to the Terms of Use
11.1. We reserve the right to modify or update these Terms from time to time. We will notify you of any material changes via the email address provided at registration or through a notification on the Platform.
11.2. Your continued use of the Platform after such changes become effective constitutes your agreement to the revised Terms. We encourage you to review this page periodically.
12. Governing Law and Dispute Resolution
12.1. These Terms shall be governed by and construed in accordance with the laws of the Republic of Kazakhstan.
12.2. All disputes and disagreements arising out of or in connection with these Terms shall be resolved through negotiation. If an agreement cannot be reached, the disputes shall be referred to the Specialized Inter-district Economic Court of Almaty.
